1. Acceptance of Terms

By accessing and using Echoes, you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

Echoes is an AI-powered platform that transforms photos into animated videos. We provide tools for creating, editing, and sharing video content.

3. User Responsibilities

You agree to:

  • Use the service only for lawful purposes
  • Respect intellectual property rights
  • Not upload inappropriate or harmful content
  • Maintain the security of your account

3.1 Photos of Other People

You confirm that for every photo you upload, you are either (a) the person in the photo, (b) have permission from the person in the photo, or (c) have parental authority over a child shown in the photo. If we receive a credible request from a person identifiable in your uploads, we may remove the affected content. You will indemnify Echoes against claims arising from photos you upload without the required permission.

3.2 Prohibited Content

You may not use Echoes to generate or upload content that:

  • depicts a real, identifiable person without their consent in intimate, defamatory, or politically misleading contexts;
  • depicts sexual content of any kind involving minors, or non-consensual sexual content involving anyone;
  • promotes violence, terrorism, hate, or harassment against a person or group;
  • infringes copyright or other intellectual property rights.

We may remove content, suspend accounts, and report illegal content to authorities without prior notice.

3.3 User-Uploaded Music and Audio

Echoes lets you add your own audio to a video. You are solely responsible for any audio file you upload. For every audio file, you confirm that you either own it or have obtained all rights necessary to use it in your video and to share, distribute, and publish that video, including any synchronization rights (the right to combine music with moving images) and rights in the specific sound recording.

You acknowledge that purchasing a track (for example from a download store) or holding a streaming subscription does not by itself grant the right to include that track in a video you share. Obtaining those rights is your responsibility.

If we receive a credible complaint from a rights holder, or otherwise believe an uploaded audio file infringes someone's rights, we may remove the audio or the affected video without prior notice. You will indemnify and hold Echoes harmless against any claim, demand, damage, or cost (including reasonable legal fees) arising from audio you upload without the required rights.

4. Payment Terms

Echoes operates on a credit-based system. Credits are purchased as one-time payments through our payment processor (currently Freemius). Credits do not expire. Pricing is shown on the credits purchase page and may change over time; you will only be charged the price shown at the moment of purchase. Section 4.5 (30-day money-back guarantee) is offered in addition to any statutory rights you have under applicable law, including the 14-day cooling-off period under Israeli Consumer Protection Law §14C.

4.1. Digital Frame Purchases

Digital frames are available for delivery within Israel only. The standard frame supplied is a new 10.1-inch Frameo-compatible digital frame with 16 GB of advertised storage. If this frame is unavailable, Echoes may supply a new replacement of equivalent or better quality and substantially similar specifications.

Delivery will take place within 10 business days after the customer has both provided complete delivery details and approved the final video version in writing. The delivery period does not begin until both requirements have been completed. Changes to the approved video or delivery details may delay delivery.

The frame will be supplied with the applicable retailer, importer, or manufacturer warranty documentation and invoice. Hardware warranty and repair service are provided according to those documents. This does not limit any rights available under applicable law.

4.5. 30-Day Money Back Guarantee

We offer a 30-day money-back guarantee for customers who are not satisfied with their purchase. To request a refund:

  • Submit a refund request through our contact page within 30 days of purchase
  • Include your email address, purchase date, and reason for refund
  • Refunds are processed to the original payment method within 4-10 business days
  • All refund requests are subject to review

Abuse Prevention:

We reserve the right to deny refund requests that appear to be abusive, including but not limited to:

  • Multiple refund requests from the same user for separate purchases made over time
  • Any other patterns that indicate systematic abuse of our refund guarantee

5. Content Ownership

You retain ownership of photos you upload. You own the videos Echoes generates from your uploads, subject to: (a) any third-party rights in the source photos, (b) the watermark on free clips remaining intact when shared, (c) compliance with section 3.2, and (d) any third-party rights in audio you upload (see section 3.3). By using the service, you grant Echoes a limited, non-exclusive license to process your uploads solely to provide the service - including sending them to the AI providers listed in our Privacy Policy.

6. Limitation of Liability

We provide the service "as is" and make no warranties about the availability, accuracy, or reliability of the service.

7. Termination

We may terminate or suspend your account at our discretion if you violate these terms.

8. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the service constitutes acceptance of the new terms.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Israel. The competent courts in Tel Aviv-Yafo have exclusive jurisdiction over any dispute arising from these Terms or your use of Echoes.

10. Copyright Complaints

We respect intellectual property rights and expect our users to do the same. If you believe that content on Echoes - including audio in a video - infringes a copyright or other right you own or represent, please contact us at contact@your-echoes.com with:

  • a description of the work you say has been infringed;
  • a link to, or description of, the specific content on Echoes you are complaining about;
  • your contact details;
  • a statement that you have a good-faith belief the use is not authorized by the rights holder or the law; and
  • a statement that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.

We will review credible complaints and may remove or disable access to the content involved. We may terminate the accounts of users who repeatedly upload infringing content.
